Elaya Homes (hereby referred to as “the Company”, “we” or “us”) provides a platform and tools to enable clients (hereby referred to as “Clients”) to manage their bookings and requests for their property (hereby referred to as “Service” or “Services”).

As a Company, we are committed to ensuring that the privacy rights of our clients are respected and so have put this Privacy Policy in place. This policy will give you detailed information as to how your private information will be used by the Company. All information regarding to the collection of, use and disclosure of confidential and personal information (received from either visitors to our site or clients) and information about our policies will be found in this Privacy Policy. This Privacy Policy provides information on our policies and procedures on how we collect use or disclose personal information we receive from clients or visitors.

Please note that this Privacy Policy may be updated periodically and you will be informed of the same immediately. We urge you to go through this policy regularly to look for any changes that may be made.

A client may be asked to provide information such as his/her name, designation, email id, company address, and phone number and so on. The information collected can be put into two categories- Personally Identifiable or Anonymous. These categories are explained below:

Personally Identifiable: This is information which is specifically related to the client – name, phone number or email address.

As a client, when you register yourself with us on our website, you will be asked for personally identifiable information, such as your first and last name, company name, title, email address, billing address, credit card information and password information for your email accounts. All information provided to us may be reviewed (and edited) in your profile by logging in. If you decide to delete all of your information, your account may be cancelled by us.

You may also upload your private data or have third parties upload your private data to our Service. This confidential information will be treated in the same manner as personally identifiable information. An archived copy of your records may be retained as required by law.

Some or all of your personally identifiable Information may be used by us to provide Services. Personally identifiable information may also be provided to intermediaries and third parties who work with us. Except as otherwise provided in this Privacy Policy, however, we will not rent or sell your personally identifiable information to third parties without your permission. No third parties will directly collect personally identifiable information through our web site or Service.

Vianaar is the owner of the information collected through the Service, provided however that you remain the owner of all business information and data uploaded to our Service.

Anonymous Information: This refers to information that cannot be linked back to a certain person. For example, the site may be visited by a large number of people but we do not know their personal information such as their area of residence, date of birth etc. Many people who visit the site do not register and provide us with such information so these people are therefore “anonymous” to us and the information collected by us about them is also anonymous information.

Please note that we will not (knowingly) collect information from children who are under 13 years of age. If it is brought to our notice that such information has been collected, then this information will be removed immediately.

The individual information we collect is mainly for general use. We use our clients’ personal information to contact them regarding their account or to inform them about new products being offered or to communicate with them about any services provided by us. For instance, if a client contacts us via email, that email address is kept on record to contact them in the future. A client is free to withdraw his/her personal information from the account at any time, but this may result in the account being closed by us. The circumstances under which we may share such information with third parties are described in question (4) below.

Storage of Individual Information?
The Company operates/leases secure data networks in order to do this. These secure date networks are protected by both password protected systems and firewalls. Our policies are reviewed periodically and updated, if required. Only certain authorized persons have access to the information provided by clients.

Third Party Hosting, Serving and Storage
The Company may also enter into agreements with different kinds of third party vendors/suppliers/providers for the purpose of hosting, serving, storage and telecommunication needs, etc.,. This includes limitation storage of our clients’ personally identifiable information. However, the Company shall not be held responsible or liable, and hereby disclaims all responsibility and liability, for culpable (including without limitation negligent) acts or omissions by its third party suppliers/vendors.

Third parties may be involved to help to operate Elaya Homes' applications and services and the Company may on these grounds share clients’ personally identifiable information with such parties. However, these third parties do not have the right to use this information beyond what is required from them to assist us.

Aggregate statistics may be shared but this pertains to demographic reports or overall patterns of user behavior and as such do not describe our clients individually.

If necessary and in order to comply with legal matters, the Company may disclose a client’s personally identifiable information if a client has violated or breached an agreement with the Company. Such information may also be disclosed or used in cases where the Company needs to take action against illegal activities, fraud or possible threat to the Company or any individual.

If the Company undergoes any business transaction such as a sale of its assets, a merger or even bankruptcy, then the clients’ personally identifiable information will be disclosed and be amongst the assets transferred. You may be notified of this via a notice on the Company’s website for 30 days of any such change in ownership or control of your personal information. The Company further reserves the right to sell, transfer or disclose your personal information to companies who are affiliated with the Company at the Company’s sole discretion.
